Please read these terms carefully before using Health Scan Express

1. Acceptance of Terms

By downloading, installing, or using the Health Scan Express mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Health Scan Express ("we," "us," or "our") regarding your use of the App.

2. Description of Service

Health Scan Express is a mobile application that uses artificial intelligence to scan and extract health measurements from digital displays of health monitoring devices, including but not limited to:

  • Blood pressure monitors
  • Digital weight scales
  • Other health monitoring devices with digital displays

The App allows you to optionally store these measurements in Apple Health on your device.

3. Medical Disclaimer

IMPORTANT: Health Scan Express is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

3.1 Not Medical Advice

The App is designed solely to help you track and record measurements from your personal health monitoring devices. It does not provide medical advice, diagnosis, or treatment recommendations.

3.2 Accuracy Not Guaranteed

While we strive for accuracy, the AI-powered scanning feature may occasionally misread device displays. You are responsible for:

  • Verifying that scanned readings are accurate before relying on them
  • Ensuring your health monitoring devices are properly calibrated and functioning
  • Consulting with healthcare professionals regarding your health data

3.3 Emergency Situations

The App is not designed for emergency use. In case of a medical emergency, immediately call emergency services or seek immediate medical attention. Do not rely on the App for time-sensitive health decisions.

3.4 Consult Healthcare Professionals

Always consult with qualified healthcare professionals before making any medical decisions based on data tracked through the App. The App is a tool for personal health tracking only and should not replace professional medical advice.

4. User Responsibilities

4.1 Age Requirements

You must be at least 13 years old to use the App. If you are between 13 and 18 years old, you must have permission from a parent or legal guardian to use the App.

4.2 Account and Subscription

Access to certain features of the App requires an active subscription purchased through the Apple App Store. You are responsible for:

  • Maintaining the confidentiality of your Apple ID credentials
  • All activities that occur under your account
  • Payment of subscription fees through your App Store account
  • Reviewing and understanding the Apple App Store's subscription terms

4.3 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use the App to upload harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems or networks
  • Use the App to scan devices or content you do not own or have permission to scan
  • Interfere with or disrupt the App's functionality or servers

4.4 Data Accuracy

You are responsible for reviewing and verifying the accuracy of all scanned health measurements before using or relying upon them. Always double-check that scanned readings match your device's display.

5. Subscriptions and Payments

5.1 Subscription Fees

Certain features of the App require a paid subscription. Subscription fees are charged through your Apple App Store account and are subject to Apple's payment terms and conditions.

5.2 Free Trial (if applicable)

If we offer a free trial period, you may cancel before the trial ends to avoid being charged. If you do not cancel, your subscription will automatically begin, and you will be charged the applicable subscription fee.

5.3 Automatic Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current subscription period. You can manage or cancel your subscription through your Apple App Store account settings.

5.4 Refunds

All subscription payments are processed through the Apple App Store. Refund requests must be submitted to Apple according to their refund policy. We do not have control over Apple's refund decisions.

5.5 Price Changes

We reserve the right to modify subscription pricing at any time. Price changes will apply to future subscription periods and will be communicated to you in advance. Your continued use of the App after a price change constitutes acceptance of the new pricing.

6. Intellectual Property Rights

6.1 Our Rights

The App, including all content, features, functionality, source code, user interface, graphics, and design, is owned by Health Scan Express and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms. This license does not include any rights to:

  • Modify, copy, or create derivative works of the App
  • Sell, rent, lease, or sublicense the App
  • Use the App for commercial purposes

6.3 User Content

Images you scan through the App are processed temporarily and deleted immediately after processing. You retain all rights to your images and health data. By using the App, you grant us a temporary license to process your images solely for the purpose of extracting health measurements.

7. Privacy and Data Usage

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

  • We do not store your health readings on our servers
  • Images are processed by third-party AI services
  • Apple Health data remains on your device under your control

8. Third-Party Services

8.1 AI Processing

The App uses third-party artificial intelligence (AI) services to process and extract measurements from device images. By using the App, you acknowledge and agree that your images will be sent to these third-party AI services for processing.

8.2 Apple Health

The App can integrate with Apple Health. Your use of Apple Health is subject to Apple's terms and conditions. We are not responsible for Apple Health's functionality or any issues arising from Apple Health integration.

8.3 Third-Party Terms

Your use of third-party services through the App is subject to those third parties' terms and conditions. We are not responsible for third-party services or their terms.

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Warranty of Accuracy

We do not warrant that:

  • The App will scan all devices accurately or at all
  • The App will be error-free, uninterrupted, or secure
  • Any errors or defects will be corrected
  • The App will meet your specific requirements

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTH SCAN EXPRESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP SUBSCRIPTION IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

9.4 Health Decisions

We are not liable for any health decisions you make based on data tracked through the App. You assume all risks associated with using health data from the App.

10. Termination

10.1 Termination by You

You may stop using the App at any time by deleting it from your device. To cancel your subscription, you must do so through your Apple App Store account settings.

10.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Failure to pay subscription fees
  • Abuse or misuse of the App

10.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. Data stored locally on your device (such as in Apple Health) will remain on your device, but you will lose access to App features that require a subscription.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

  • Update the "Last Updated" date at the top of these Terms
  • Notify you of material changes through the App or via email (if available)
  • Provide a reasonable period for you to review changes before they take effect

Your continued use of the App after changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

12. Governing Law and Disputes

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through good faith negotiations. If negotiations fail, disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.

13. Indemnification

You agree to indemnify, defend, and hold harmless Health Scan Express, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any health decisions made based on App data

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Health Scan Express regarding the App and supersede all prior agreements and understandings, whether written or oral.
